( 171 ) March ye 8th 1691/2 Their. Maties - - - - - - - - - - - - Contra. } Somerset County Sc. Robert. Down of this County Planter was attached Robert Down - to answer what should be objected agt him at a County Court held the Second tuesday in August in their Maties behalf _____ - - - - - _____ - - - - - And whereupon their Maties Attorney Comes and Sayes that the said Robert Down dft not having the fear of God before his eyes but wickedly and presumptuously did together with One John: Kemp of ye Same County Planter in the month of August 1690 Range and Scoure the woods within the Jurisdiction of this Court without Licence or Comission from the authority of this their Maties Province, and then & there did take up and felloniously brand One gray Maer of the price or value of Nine hundred ninety and nine pounds of tobacco, and the Same did Conceal from the knowledge of their Maties Officers for that purpose authorized and appointed the said Maer being neither the Right of him the sd Downs or Kemp his Confederate Contrary to the good Laws & institutions of this Province and to the great hurt & detriment of ye inhabitants and agt the public peace. Therefore their Maties Attorney Craves judgmt may be entered agt the said Downs & that he Suffer the pains and punishment by the Law inflicted agt Such Offenders &ca James: Sangster Clr. Indtmts. __ __ ___ The foresd Indictment being read, to which the said Robert Downs pleaded not guilty and for tryall put him Self upon the Country. viz the Same Jury as of John: Kemp. which Said Jury was - Legally Sumoned returned and Sworne, as also the Same Evidences as of sd Kemp wer Sworne, and having heard the totall proceedings are Sent forth. _____ Which said Jury imediately after returned with this following verdict: being thereto all agreed ( to witt) Wee of the Jury finde Robert: Downs not guilty of the Indictment. Henry: Hall foreman. _________ - - - - - _____ Their Maties Somerset County Sc. The Jurors for their Maties being Sworn upon the holy Contra: } Evangelists at a grand Jury held for this County the last Tuesday in September Eliz: Wildgoos doe present and find that Elizabeth Wildgoose of BogatoeNorton hundred at Sea - - - - - - - Side, and within the Jurisdiction of this Court; hath most wickedly Sinfully and Shamefully Comitted ffornication and born a Basterd Child, to the great dishonour of Almighty God, Scandall and Evil Example, to their Maties good people of this Province, and against the laws and institutions of this Province Their Maties Attorney Craves judgment may be entered agt the Offender according to Law in that Case prvided James: Sangster. Clr Indtmts. The Indictmt being read to wch. the said Eliz Confessed. And said that Cornelius Innis was the ffather of her late Basterd Child, Whereupon this Court Ordered that the sd Cornelius appear the next County Court to answer to wht Shall be Objected agt him on behalf of their Maties ________ - - - - - - ______ - - - - - _____ - - - - - Ordered Likewise the said Elizabeth Wildgoose be fined thirty dayes work diet and tools. Ordered also that she remain in Sheriffs Custody till Security given for the said fine behaviour and fees. vid. 183: Security
