March the 8th. 1691/2 ( 170 ) Their Maties Somerset County Sc. John: Kemp of this County Planter was attached too Contra } answer what should be Objected agt him at a County Court held the John : Kemp - Second tuesday in August in their Maties behalf _____ - - - - - _____ - - - - - - - - - - - - And whereupon their Maties Attorney Comes and Sayes that the said John: Kemp. Deft not having the fear of God before his eyes but wickedly and presumptuously, did togeather with One Robert: Downs in the month of August 1690: Range and Scoure the woods with in the Jurisdiction of this Court not having any Comission from the authority of this their Maties Province, and then and their did take up and felloniously Brand One Gray Maer of the price of nine hundred ninety and nine pounds of tobacco and the said Maer did Conceal from the knowledge of their Maties Officers for that purpose authorized and appointed, the said Maer being neither the Right of the said Kemp or of the said Downs his Confederate, Contrary to the good Laws and institutions of this Province. And to the great detriment of the Inhabitants and agt the public peace. Their Maties Attorney Craves judgmt. may be entered agt the said Kemp, and that he Suffer the pains & punishments by the Law inflicted upon Such offenders &ca. James Sangster Clr Indtmts. ____ - - - - - - - The aforesd. Indictmt. being read, to which the said John: Kemp pleaded not guilty, and for his tryall put him Self upon the Country. whereupon Comand was given to the Sheriffe to bring in Court twelve good and lawfull men of his Balywick, that the matter in hand might be the better understood. A list or pannel whereof are thus returned as appears upon ye left hand being legally Sumd & Sworn upon ye holy Evang:ls viz - - - - - - - - having heard the foresd Decl.alias indictmt. read as also the Oaths of four - Henry: Hall. Evidences, receives their Charge and are Sent forth _______ - - - - - - ___ Walter: Talbott. Edward: Evins. John: Colhoone. And the same day viz the 8th: day of March the aforesd Jury as in ye William: Porter. Margent appears in Court, the plt and deft. being Called, as also the Jurors each Roger: Burkum. man perticuliarly by his name, and being asked, are all unannimously agreed William: Planner. Junr of their verdict, which being delivered is thus read viz. Wee of ye Jury James: Ingram. doe find John: Kemp guilty of the Indictment. Henry: Hall: foreman . Joseph: Bainton. Order given by this Court to enter the verdict. Order given for ye Jurors fees John: Browne. Order ye Said Kemp remain Sheriffs Custodie till he give Security for his good Thomas: Tull. behaviour, four fold, & Cost of Suit Thomas: Smith ______________________ Evid Sworn for plt.
