Their Maties Somerset Ssc. Edward: Sadbury of this County Planter by vertue of A
Contra: } warrant directed to mr Stephen Luffe of this County high Sheriffe by
Edward: Sadbury Coll. David Browne, one of their Maties Justices of the Peace, bearing date
- - - - - - - - the 25th. day of 9ber 1691. to answer what should be Objected agt him On
behalf of their Maties at the County Court held the Second tuesday in January
Now the Jurors for their Maties being Sworn upon the holy Evangelists at the said County Court do present
and find that the said Edward Sadbury upon the 20th: day of 9ber last past at the Plantation of the said
Sadbury in Monokin hundred and within the Jurisdiction of this Court not having the fear of God before his
eyes did most wickedly and felloniously Steal kill and Clandistinly Swinge One hogg of the value of 200lb
of tobacco, propperly belonging to the said Henry Phillips and then and there did maliciously, wickedly
and felloniously the same Steal as Said is Contrary to the good laws & institutions of this Province ye
great damage and evil Example to their Maties good people, and agt the publick peace their Maties
Attorney Craves judgment may be entered against the Offender according to Law . - - - - - ____ - - - -

The foresd Indictment being read to which the said Sadbury pleaded not guilty and for Tryall -
thereof, was referred to a Jury. Comand then pr Court was given to the Sheriffe of this County to Sumon
twelve good and lawfull men of his Balywick that the matter in hand might be the better known A List
or pannel whereof by the sd Sheriffe are returned as in the Margent on the left hand . ____ - - - - ____
Henry: Hall. Which foresd Jury being Sumoned and legall returned and Sworn upon the holy
Walter Talbott Evangelists having well heard the Indictmt. as also the testimonies of four Evidences
Edward: Evins duely Sworn, receives their Charge and are Sent forth to Cognize & determine ye Same.

Wm: Porter And this day (viz) the 8th: day of March Anno. 1691/2: The Same Jury as
Roger: Burkum. in the Marg. appears in Court, the plt and dft being Calld, are all unanimously agreed
William:Planner Junr of their verdict, which being delivered is thus read (Viz) Wee of the Jury doe find
James: Ingram Edward: Sadbury guilty of the Indictment, also value the hogg at One hundred &
Joseph:Bainton. fifty pound of tobacco. Henry: Hall. foreman _______ - - - - - _____ - - - - __
John: Browne. Whereupon this Court Orders the verdict to be entered, and Orders the sd Sadbury
Thomas: Tull. to pay four fold to Henry: Phillips. Ordered likewise sd Sadbury doe not Carry dogg or
Thomas: Smith Gun of from his own plantation to range the woods. Ordered Henry Philips pay the
____________ Jurors fees. ____ Order likewise the sd Edward Sadbury give Security for sd fourfold
Evidences viz good behaviour and Cost of Suit. Ordered likewise that Sadbury remain in ye Sheriffs
