9ber 13th. 1691 ( 138 ) Their Maties Somerset County Sc. Hough Conner, was by Recognizance bound Over Contra. } to answer what shold be objected agt him in November Court & whereupon Heugh: Conner their Maties Attorney Comes and Sayes that the sd Hough Conner deft of - - - - - - - Pocomoke River, & within the Jurisdiction of this Court upon the first Satterday And first Sabboth in May last past, at the house of Lawrence: Crawford did togeather with Jno. Lynch. George Negro of mr ffrancis Therrewgood, did most wickedly & felloniously Steal & Cary away Severall goods & Commodities out of the Store of mr Peter Dent at the Plantation of mr Edmund: Howard viz Six gallons of Rum & twelve pounds of Suger, to the value of three hundred pounds of tobacco & at the Said house of mr Lawrence Crawford in his absence & upon the Sabboth day did Consume & destroy the Said Rum & Suger, & himself made drunk, to the great abuse of the Laws humane & devine, Scandall & evil Example to the good people of this Province & agt the publick Peace -- Their Maties Attorney Craves judgmt . may be entered agt the Said Offender according to Law in that Case made and provided. &ca. -- 9ber Court 1691 Ja: Sangster . Indts The Indictmt being Read to which the sd Conner pleaded not guilty. his tryall being referred to a Jury whose names appears on the left hand, which sd Jury was legally Richard: Chambers Sumoned & Sworne, who having heard the foresd Indictment read, as also Seen and Thomas: Morris. heard the Two evidences Sworne & Examd. viz Jno. Lynch & Eliz: Cunningham -- John: Jones receives their Charge and are Sent forth in Order to determine ye matter. -- Joseph: Gray Ja: Obrinyton And this day (viz) the 13th day of November Anno Dom 1691. the John: Bennett. foresaid Jury being returned in Court being unnamously agreed, the Wm: Denison Plt & deft being Called. the verdict is read as followeth viz . Wee John: Sanders of the Jury finds Hough: Conner not guilty. Rich. Chambers foreman Roger Barker Wm: Innis. Which verdict was Ordered to be entered as aforesd. -- Likewise this Court Roger Philips further Orders. that the Sheriffe of the County take the sd Conner into Custody till Jno. Scolfield. he give Security for his good behaviour &ca. _____ ~ ~ ~ ~ ~ ~ ________ Whereupon Came the Said Hough: Conner & by Recognizance did Confess himselfe to be justly indebted to their Maties. Wm. & Mary King & Queen Over England &c. the Sum of Tenn pounds Sterling money of England due to be Leavied on his goods & Chattels for their Mataies uses &c. - Likewise Came ye Said Conners two Securities viz. John: Magnet & Moses ffenton. and did also Confess themselves justly indebted to sd Maties in ye Sum of 5 pounds a piece like money to be leavied as aforesd . -- -- _______ ~ ~ ~ ~ ~ ~ _____ ~ ~ ~ ~ ~ _______ ~ ~ ~ ~ ____ The Condition of which Recognizance is Such that if the above bound Hough: Conner, be of the good behaviour & abearance to all their Maties Lieg people of this Province, dureing the Courts pleasure as also pay Court fees then the Recognizance void Otherwise to be & remaine in full power force & vertue Arnold: Parramore Dr to Coll.
