( 137 ) The abovesd Indictmt . being read, to which the sd Benson pleaded not guilty. yett after a while Confessed and being Sory desired to be tryed by their worpps. -- The Court having duely weighed the matter and having had a good report of the sd Benson in Court doe impute it to be rather ignorance then prmeditated injury. upon which the Court thought fit at least to fine the sd Benson five hundred pounds of tobacco, and did likewise Order the Sheriffe to take the sd Benson into Custody till Security given for the payment of ye Said 500lb. tobacco to Capt. Charles: Tindall in this County Cordweiner. in Contra } June Court was bound over to answer what should be Objected agt him Charles: Tindall. On behalf of their Maties ______ ~ ~ ~ ~ ~ _____ ~ ~ ~ ~ _____ - - - - - - - And whereupon their Maties Attorney Comes and Sayes that William: Morris late pf this County for Severall high and Capitall Crimes was by mittimas Comitted to Goale. by John: Starrett of Pocomoke Constable, and the Said Morris upon the 16th day of May last past being Conscious of his owne guilt and demerit: his prison did break, and from mr Stephen Luffe of this County high Sherife, did felloniously make his Escape which Said imprisonment & escape was made known to the Inhabitants of this County, by Hue & Cry raised in pursuit of the said Prisoner. Yett Notwithstanding of the said Hue & Cry.The Said Charles:Tindall,did accompany Converse barter and Swapp, with the said Morris, and him his Said Escape, did aid and assist, by Selling him an horse for to Carry him Out of the Province, and lett him have a Compasse with a dial to Steer his Course by, by which wicked & fellonious act the Said Morris hath Escaped the punishment due to so heynious a Crime, as most horrible and ye grocest of Blasphemy doth justly deserve. Thereby greatly offending, and Cotemning the Laws, both humane & devine Giving Evil Example to the good people of this Province, & against the Publick peace. Wherefore their Maties = Attorney Craves judgmt. may be entered agt the Said Charles Tindall. according to Law in that Case made & provided August Court. 1691 Jas Sangster. Clr. Indtmts ________________ ~ ~ ~ ~ ~ ~ ~ ~ __________ ~ ~ ~ ~ ~ ~ ~ The Indictmt being read to which the said Charles Tindall pleaded not guilty in manner & forme, and for tryal puts himself upon the Country. _____ Whereupon Comand was given to the sherife to Sumon twelve good & lawfull men of his Balywick that the matter might be the better known a list or pannel are returned Jurors as appears upon the left hand. all being legally Sumond & duly Sworne upon the holy Evangelists viz Lawrence Crawford Evidences Sworne The Said Jury having heard the Indictmt. read as also seen & heard John: Outen. agt the deft were the Evidences Sworned & Examined, receives their Charge & are Sent forth Walter Read Ralph: Doe - - - - in Order to determine the matter ____ And this day being the 13th. day Robert. Johnson Jeremiah. Townsend of November Anno Domini 1691 the aforesd Jury to the Barr in Court ffrancis Joyce. William: Harper. - are returned being unamously agreed ye plt & deft being called the Rich: Holland Daniel: Dunnahoe verdict is read as followeth (viz) Wee the Petty Jury find Charles Wm: Elgate Henry Ayres -- & Tindall guilty of Correspondency with Wm: Morris after Heue Thomas: Rolph.
