( 136 ) To the worll. Justices of Somerset County in Court Sitting the humble Petion of David Browne the Execcutor of Archibald Ereskine deceased humbly sheweth -- That mr Samuel Cooper decd became indebted unto the Extor of the sd Ereskine the Sum of One thousand, eighty & Six pounds of tobacco pr accot. of which Bill and accot. your Petioner hath recd no part or percell of Satisfaction your Petioner humbly Craves judgmt for the Said debt agt mr ffrancis: Jenckins Admr of the Estate of Samuel: Cooper, And your Petioner as in duty bound shall pray. David Browne. -- Petion not granted. Sd Jenckins refused to Confess judgmt ~ ~ ~ ~ ~ _____ ~ ~ ~ ~ ~ _______ ~ ~ ~ ~ ~ The Courts adjourned till tomorrow at nine of the Clock . -- Maryland Somerset County Sc November the 13th 1691 . at a Court then held Comrs Present Coll. David Browne. mr ffrancis Jenkin. Majr. Robert: King. mr James. Dashiels. in Court were } Capt. John: Winder. mr. Samuel: Hopkins. mr. Edmund: Howard mr Ge:Layfield. Capt.;Jno.King After the Court was Called. The Jurors were Ordered to be called, all appearing except Wm: Innis & Roger: Philips. for which remissness the Court Ordered them to be fined, unles they could show cause. and forth with Came the sd Innis & Philips, craved pardon of their worpps. and then there fine was remitted. Ordered by this Court that Peter Whaples be forthwith Secured, till he give Security to answer to their Maties what shall be Objected agt him ye next County Court to be holden the Second tuesday in Janry 1691 Their Maties Somerset County Sc. George: Bensone of this County Planter was attached to Contra answer unto their Maties, what shall be Objected agt him the Second tuesday George: Benson } in August ____ ~ ~ ~ And whereupon their Maties Attorney Comes & Sayes - - - - - - - That whereas William Morris late of this County was apprehended by John Starrett. Constable of Pocomoke hundred & by him Conveyed to mr Stephen:Lufe high: Sheriffe for this County by vertue of a Mittimus for Several high Crimes, & misdemeanours imprisoned by the sd high Sheriffe, and afterwards the sd Morris upon the 16th: day of May last past, his Prison did break and from the said Sheriffe did felloniously make escape, which sd imprisonment being well known to the Inhabitants of this County by reason of a Hue & Cry raised in pursuit of the said Morris, The said George did not only Conceal, aid assist & preserve the sd Morris but also Secretly Conduct & Convey the sd Morris without the Jurisdiction of this their Maties into the Province of Pennsilvania by which wicked & fellonious act the said Morris hath escaped the punishment due to so heinous a Crime, as most horrible & gross Blasphemy doth justly deserve. But also the said George hath. Contemned the good laws & institutions of this Province,highly offended - Allmighty God. And given evil Example to their Maties good people of this Province, and breach of ye publik Peace. Wherefore their Maties Attorney Craves judgment may be entered agt the Said George Benson, according to Law in that Case made & provided. &c. Ja. Sangster. Cl: Inditmts August Court 1691. //
