( 135 ) 9ber 12th 1691. Their Maties Somerset County Sc. The Jurors for their Maties being Sworne upon the Contra holy Evangelists at a County Court held the Second tuesday in March last Matthew: Scarbrough past, doe present and find that Matthew Scarbrough the first Lords day or Sabo in August Anno Domini 1687. at his owne house in Mattapony hundred and within The Jurisdiction of this Court did most unseemly and unchristian like behave him Selfe by villifying rayling and abuseing Some of theire Maties Comrs for this County and then & there did drinke to that excesse that both in Speech and behaviour was Exceeding drunke; Not regarding the said Sabboth or Lords day the welfare either of body or Soule but in Contempt of the Sacred Laws of Allmighty God, the good & wholesome Laws of this their Maties Province thereby dishonouring God, Giving Scandall & evill Example to the people, and agt the publick Peace. Therefore there Maties Attorney Craves judgment may be entered agt the sd Scarbrough according to Law in that Case made and provided . -- ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Ja. Sangster Clr: Indtmts The abovesd Indictmt. being read to which the sd Scarbrough pleaded not guilty, and therefore the matter was referred to the Same Jury as aforesd in fo: 134: -- which Said Jury being legally Sumoned and Sworned having heard & Seen the Evidences Sworn & examined as Sent forth to determine the matter. -- and this day being the 12th day of 9ber Ann. Dom. 1691. the sd Jury being returned in Court, the plts & deft being Calld. this verdict is delivered (viz) Wee of the Jury findeth not guilty = Rich Chambers foreman Evidences Sworne in both tryals agt Matt: Scarbrough. Scarbrough. were Jonathan Wolfenden } and Mary his wife _______________ ~ ~ ~ ~ ~ ~ ~ ~ dismist pr Court. Maryland. Sc. Know all men by these presents that I Benjamine Keizer of Somerset Count am holden and firmly bound unto John: Colhown. of the Same County Carpenter in the full and just Quantity of three thousand Six hundred foot of good Sound Merchantable Planke, to be paid unto the sd John:Colhown his Heirs Execctors Admrs or Assigns Convenient at Some Landing in Pocomoke River to the which paymente well & truly to be made. I bind my Self my Heirs Extors & Admrs firmly by these presents. In wittness whereof I have hereunto Sett my hand & Seal the 5th day of January Anno Dom. 1689./90 _____________________ The Condition of the above Obligation is Such that if the above bound Benjamine Keizer shall well & truly pay or Cause to be paid unto the abovesd John:Colhown his Heirs Extors Admrs or Assigns the just quantity of Eighteen hundred foot, of good Sound Merchantable planke on or before the fifteenth day of June next ensueing the date. then this present Obligation to be void & of no effect Otherwise to Stand remayne and be in full force power and vertue Benj: Keizer.
