( 100 ) To a marked to a marked white Oke standing near the head of the aforesd gutt,thence with a line drawne South fourty Six degrees Easterly eighty eight pole to another marked white Oake standing near the head of Harts Creek being y first bounder of a tract of Land formerly Surveyed for Robert Hart, called Harts Ease, and also a Corner tree of the tract called Pomfrett aforesd, thence along the line of the tracts aforesd Southwest Seventy eight pole, thence down Harts Creek North twenty nine degrees westerly thirty two pole, thence North Sixty two degrees westerly twenty four pole, and from thence with a right line drawn to the first bounder containing fifty five Acres fifteen Rood, which shall hereafter be called by the name of the ffathers intent, togeather with all and singular its rights profitts priveledges wayes easements houses, ffences, Orchards, timber or timber like trees thereupon, with all other the appurtenances thereto belonging, or in any wise appertaining to have & to hold to him the said Robert Coulbourne his Heirs and Assigns for ever to the only propper use and behoof of him the sd Robert Coulbourne and to him as said forever, wthout any Mortgage, Condition, Limitation, use or redemption to recall, alter charge or determine the same. The Rents and Services due to the Lord and Lords of the ffee allwayes excepted & foreprized,and the sd William Coulborne, Sonn of Coll. William: Coulbourne deceased and Anne his wife aforesd, for them Selves their Heirs Execcutors and Administrators and every of them the aforesd tract or percel of Land called ffathers intent, with the appurtenances before by these presents bargained and Sold unto him the said Robert Coulbourne, doth for ever fully acquitt and discharge the Same of and from all manner of former bargains, Sales, forfeitures, Dowries, Joynters, Surrenders, and of and from all other titles incumbrances, claims, and demands whatsoever had, made, done, counted, Suffered, or procured by the sd William Coulbourne or Anne his wife, their Heirs or Assigns or by any of them or by any other person or persons whtSoever by their or any of their means consent or procurement, And the sd William and Anne for themselves their Heirs Execcutors and Admrs and every of them do Covenant and agree to and with the said Robert: Coulbourne his Heirs and Assigns and every of them, that the sd Robert: Coulbourne his Heirs and Assigns shall and may from time to time and at all times hereafter, peaceably and quietly for ever, have, hold, occupie, posess and enjoy for ever the the said bargained land and premises without the lett interuption or expulsion of the said William and Anne his wife, their Heirs or Assigns or of any person or persons whatsoever, now having or lawfully claiming to have, or wch hereafter may have any manner of Estate, right, title, interest or demand, of in or out of the sd bargained premises, or any part or percell thereof, and further the said William and Anne his wife hath good right, full power and lawfull authority to grant bargain and Sell the Same, to him the sd Robert Coulbourne and to his Heirs forever,as they will forever hereafter warrant and defend the same to him the sd Robert Coulbourne and to his Heirs forever against all prSons whatsoever claiming or to claim by from or under them or any of them. And the sd William: Coulbourne and Anne his wife for themselves and for their Heirs, Execcutors & Admrs, doth further grant Covenant and agree to and with the sd Robert Coulbourne his Heirs and Assigns, that they the said William and Anne his wife or their Heirs shall & will from time to time and at all times hereafter for and dureing the space of Seaven years next ensueing the date hereof at and upon the reasonable request, & only at the Cost & Charges in ye Law of him the sd Robt. Coulbourne his Heirs or Assigns or any of them, doe, make acknowledge, execute & Suffer or cause to be done made acknowledged executed and Suffered, all and every Such act, thing and things, devise and devises, assurances and Conveyances for ye more better and Sure making and conveying all and Singular the bargained premises and every part and percell thereof unto the sd Robt Coulbourne or his Heirs or Assignes meaning of these prSents, as the said Robert Coulbourne or his Heirs or Assignes or by his or their Councel Learned in the law, shall be reasonably advised, devised or required for the more better making, doing Suffering & performing Such further Act and acts, thing and things, devises and assurances as shall be adjudged most Convenient, So as the said Robert Coulbourne his Heirs or Assigns be not compelled to travell any further then the Citty of St. Maries in this Province |
