CHAPTER 22.
(Senate Bill 26)

AN ACT to repeal and re-enact, with amendments, Sections
5(m), 6(i), and 7(a) of Article 72 of the Annotated Code
of Maryland (1939 Edition), titled "Oysters and Clams",
as said sections were enacted by Chapter 929 of the Acts
of 1945, and as Section 5(m) was amended by Chapter
604 of the Acts of 1947, and to add a new section and
new sub-section to said Article of said Code, to be known
as Section 5A and Sub-section 16 (c-1), Section 5A to
follow immediately after Section 5 of said Article, and
Sub-section 16(c-1) to follow immediately after Sub-sec-
tion 16(c), as amended by Chapter 604 of the Acts of
1947, relating to the seasons for taking oysters and the
manner in which oysters may be taken.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 5(m), 6(i) and 7(a) of Article 72 of the
Annotated Code of Maryland (1939 Edition), title "Oysters
and Clams", as said Sections were enacted by Chapter 929
of the Acts of 1945, and as Section 5(m) was amended by
Chapter 604 of the Acts of 1947, be and they are hereby re-
pealed and re-enacted, with amendments, to read as follows:

5(m). Tonging Seasons. It shall be unlawful to take or
catch oysters by tongs or patent tongs except during the
tonging season which shall begin on the first day of Septem-
ber in each year and end on the fifteenth day of April next
succeeding, except in the following waters where the tonging
season shall be as follows:

Patuxent River...... September 15 to March 31, inclusive

Dorchester County, except Choptank River...... October 1

to April 15, inclusive.

Choptank River........ September 1 to April 15, inclusive.

Upper Potomac River above a line joining North Point and
Cedar Point...... October 1 to April 15, inclusive.

Lower Potomac River below a line joining North River and
Cedar Point.... September 15 to April 15, inclusive.

Tributaries of the Potomac.. October 1 to April 1, inclusive.

Somerset County...... September 15 to April 15, inclusive.

Rhode River............ October 15 to April 15, inclusive.

West River............ October 15 to April 15, inclusive.

Herring Bay.......... December 1 to April 15, inclusive.

Upper Nanticoke River above a line joining Sandy Island
and Roaring Point.. October 1 to April 15, inclusive.

Wicomico County except Upper Nanticoke River.... Septem-
ber 15 to April 15, inclusive.

Worcester County.... January 1 to December 31, inclusive.
