for the sale of said bonds as a whole or in parts, reserving
unto itself the right to reject any and all bids. Said bids
together with such certified checks as may be required shall
be filed with the City Clerk and at the time and place adver-
tised shall be opened by him in the presence of the said Mayor
and City Council, and if said bids be satisfactory to the said
Mayor and City Council, it shall sell said bonds or any part
thereof to the highest bidder or bidders therefor, of whose
ability to comply with the terms of sale the said Mayor and
City Council, in its discretion, is satisfied. In the event that
the bonds be sold, the proceeds thereof shall be placed in a
separate fund and shall be used for the purpose of acquiring
land and constructing such works of any kind or character
within or without the City Limits or within or without the
State of Maryland as may be necessary to protect the City of
Cumberland and the inhabitants thereof from floods occurring
in Wills Creek and/or the Potomac River, and for the pay-
ment of all expenses incident to carrying out said work.

SEC. 4. And be it further enacted. That the Mayor and
City Council of Cumberland be and is hereby authorized and
empowered to accept from any Federal or State agency grants
for or in aid of flood protection for said City, and to make
such contracts containing such terms, provisions and condi-
tions as in the discretion of the Mayor and City Council may
seem necessary, proper or advisable for the purpose of obtain-
ing or securing grants, engineering or financial assistance
from any Federal or State agency willing to extend the same
in furtherance of the purposes of this Act.

SEC. 5. And be it further enacted, That any and all Acts
or parts of Acts or any part or parts of the Charter of the
City of Cumberland, Maryland, conflicting in any way here-
with, is or are repealed insofar and to the extent that the
same shall so conflict, and none of the limitations or restric-
tions on the power of the said Mayor and City Council to
borrow money or issue and sell bonds contained in the Charter
of said municipality or in any other law which limits, re-
stricts or in any other way affects the powers herein granted,
nor any of the provisions of Chapter 630 of the Acts of 1939
of the General Assembly of Maryland, shall be applicable
hereto.

SEC. 6. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety, and having
been passed by a yea and nay vote, supported by three-fifths
of all of the members elected to each of the two Houses of
the General Assembly of Maryland, the same shall take effect
from the date of its passage.
