said property, as the court may award; but if set aside,
the said court may direct another inquisition to be taken
in the manner above prescribed, and such inquisition
shall describe the property taken, or the bounds of the
land condemned, and the quantity or duration of interest
in the same valued for the company, and such valuation
when paid or tendered to the owner or owners of
said property, or his, her or their legal representatives,
shall entitle the company to the estate and interest in
the same thus valued, as fully as if it had been conveyed
by the owner or owners of the same, and the valuation
if not received when tendered, may at any time thereafter
be received from the company, without cost,
by the said owner or owners, or his, her or their legal
representatives; and every juror shall be entitled to one
dollar per day while in attendance, and the sheriff to
his regular fees as for similar services; Provided, always,
that no timber shall be cut on any land, other
than the bed of the rail road, by order of the said company,
or taken by them for the use of the said road,
without the consent of the owner.
     If set aside
court may direct
another
inquisition.
















Proviso.
     SEC. 7.  And be it enacted, That the Legislature
hereby reserves the right to repeal, alter or amend his
act at pleasure.

                           CHAPTER 411.

AN ACT to amend the charter of the Philadelphia, Wilmington
             and Baltimore Rail Road company.



     Passed May
30, 1853.
     SECTION 1.  Be it enacted by the General Assembly
of Maryland,
That the Philadelphia, Wilmington and
Baltimore rail road company, are hereby authorised to
sell the stock of said company, or the bonds of said
company convertable into the stock thereof, at such
prices and on such terms and conditions as the said
company may deem expedient, and that said company
may declare dividends payable in stock, until their
bridges and roads are built, repaired and improved, and
the expenses incident thereto liquidated.
     Authority to
sell stocks.
     SEC. 2.  And be it enacted, That this act shall take
effect from the date of its passage.
