     SEC. 2.  And be it enacted, That this act shall take
effect from the date of its passage.

                           CHAPTER 401.

AN ACT to authorise the Hampshire Coal and Iron
     Company of the State of Virginia, to purchase and
     hold mineral lands in the county of Allegany, in the
     State of Maryland.
     Authority to
purchase estate,
&c.





Proviso.
     SECTION 1.  Be it enacted by the General Assembly
of Maryland,
That the Hampshire coal and iron
company of the State of Virginia, be, and hereby is
authorised to purchase, lease, use, transfer and sell or
otherwise dispose of, estate, real, personal and mixed,
or any coal or other minerals in the county of Allegany,
in the State of Maryland; Provided, the real estate,
coal or other minerals hereby authorised to be purchased,
held, and owned by the sid company shall not exceed
three thousand acres.
     Power to
carry on mining,
&c.












Proviso.
     SEC. 2.  And be it enacted, That the said company
shall be, and hereby is authorised to carry on the business
of mining and manufacturing, and for this purpose
shall have all the rights, powers and privileges
granted by the general laws of this State passed at
January session, eighteen hundred and fifty-two, chapters
three hundred and twenty two and three hundred
and thirty-eight, and any amendments now in force or
which may hereafter be enacted, relating to mining or
manufacturing companies in the said State of Maryland;
subject, however, to all and every restriction and
limitation prescribed by the said laws or amendments,
or which may hereafter be prescribed; Provided, in
the event of the said company constructing a rail road
or rail roads, under and by the laws aforesaid, the same
shall commence at the mine or mines, or place or places
of operation of the said company, and shall terminate
at some point on the Baltimore and Ohio rail road
or Chesapeake and Ohio canal; and over and by the
said Baltimore and Ohio rail road or Chesapeake and
Ohio canal, the products of the said mine or mines shall
be shipped or transported to market.
