     SEC. 4.  And be it enacted, That the said burgess
and commissioners shall have the same power to collect
the amounts assessed against persons benefitted by
the opening of streets, lanes or alleys, and in the same
manner as they now have by law to collect taxes and
other debts or damages for other corporation purposes,
and the amounts of assessments so collected shall be
apportioned to the payment of damages, and other expenses
incurred in the opening of said streets, lanes or
alleys; Provided, that nothing contained in the provisions
of this act, shall be so construed as empowering
said burgess and commissioners to levy a general tax,
for the purpose of opening alleys.

Proviso.
     SEC. 5.  And be it enacted, That all acts of Assembly
inconsistent with the provisions of this act, are
hereby repealed.
Repealed.


                           CHAPTER 400.

AN ACT relating to the sale of real estate by Constables,
               who have removed from this State.



     Passed May
31, 1853.
     SECTION 1.  Be it enacted by the General Assembly
of Maryland,
That in case any constable has sold,
under execution, any lands or tenements, and hath removed
beyond the limits of the State without executing
a deed of conveyance to the purchaser or purchasers
thereof, the judges of the several circuit courts in this
State for the counties in which said lands lie, and the
judge of the superior court of Baltimore city, in case
the lands lie in the said city, on application by
petition in writing by the purchaser or purchasers or by
their legal representatives, are hereby authorised and
empowered to appoint some person to execute and deliver
the deed to the said purchaser or purchasers or
their legal representatives, for the lands and tenements
so sold, and such deed of conveyance being executed
and acknowledged according to law, shall be as operative,
in law, to every intent and purpose as if executed
by the constable who made such sale; Provided, the
said sale shall have been confirmed by the late county
courts, or shall hereafter be confirmed by the several

appoint person
to execute
deed.
