with the provisions of the twenty-fourth section
of said
act of November session, seventeen hundred and
ninety-three, chapter sixty-six; and provided also, that
if any land or other property shall be condemned for
the purpose of opening streets or alleys in the extension
of the limits of said town, the value thereof shall be
ascertained, according to the requirements of said act,
unless the said commissioners, or a majority of them,
and the owner or owners of said land shall agree upon
the valuation thereof, or appoint arbitrators to ascertain
the value thereof; Provided further, that nothing herein
contained shall authorise private property to be taken
for the purposes herein mentioned, without just compensation
as agreed upon between the parties, or awarded
by a jury, being first paid or tendered to the party
or parties entitled to such compensation.

Duty of bailiff.
|
Sec. 2. And be it enacted,
That hereafter, upon the
appointment or election of overseers or supervisors of
the roads in Dorchester county, the duties of the bailiff
of the town of Cambridge shall be confined to the streets,
alleys or roads, within the limits of said town, and
those portions of roads beyond the limits which have
heretofore been embraced within his sphere of duty,
shall henceforth be subject to the same control and jurisdiction
of the county commissioners, or supervisors
of roads, as all other roads in said county.

SEC. 2. And be it enacted,
That this act shall take
effect from the date of its passage.

CHAPTER
64.
AN ACT declaring the assent of the Legislature of a
certain bequest of Mary Buckey, late of Frederick
county, deceased, and to authorise the payment thereof
to the Evangelical Reformed church of Frederick.

Preamble.
|
WHEREAS, A certain Mary Buckey,
of Frederick
county, in and by her last will and testament, bequeathed
the sum of one hundred and fifty dollars to the Consistory
of the German Reformed church of Frederick
town; And whereas, it is represented to this General
Assembly, that since the date of said will, the congregation
worshiping in the said German Reformed church
of Frederick town, have been duly incorporated under
