CHAPTER 350.
AN ACT amendatory of, and to revive the act entitled,
an act to incorporate the Choptank and Delaware
Rail Road Company.

Act revived.
|
SECTION 1. Be it enacted
by the General Assembly
of Maryland, That the act entitled, an act to incorporate
the Choptank and Delaware rail road company,
passed at December session, eighteen hundred and forty-seven,
chapter two hundred and sixty-three, be, and
the same is hereby revived.

Commissioners.
|
SEC. 2. And be it enacted,
That Henry Horsey,
Francis A. Porter and James H. Fountain, be, and
they are hereby appointed commissioners, to act in
conjunction with the commissioners appointed by the
first section of said act, under the direction of whom
subscriptions may be received for the purposes in said
section mentioned.

Capital stock.
|
SEC. 3. And be it enacted,
That the capital stock of
the said Choptank and Delaware rail road company shall
be sixty thousand dollars, to be divided into shares of
twenty dollars each, instead of twenty thousand dollars,
to be increased at the discretion of the commissioners
or the directors to be appointed, as provided for by the
second section of the aforesaid act.

Road to be
commenced.
|
SEC. 4. And be it enacted,
That if the road mentioned
in the original, act to which this is amendatory,
shall not be commenced within five years from the
passage of this act, then this act shall be null and void.
|
Powers.
|
SEC. 5. And be it enacted,
That the said company
shall have all the powers, and be subject to all the restrictions
contained in the said original act, except so
far as the same is herein provided for.

Construction
of act.
|
SEC. 6. And be it enacted,
That nothing in this act
contained shall be so construed as to authorise the said
company to take for its use any private property, without
just compensation as agreed upon between the
parties, or awarded by a jury, being first paid or tendered
to the party entitled to such compensation.

Meeting.
|
SEC. 7. And be it enacted,
That the meeting of
the stockholders, as provided for in the sixth section of
said original act, shall be, on the first Monday of June,
after the organization of said company, instead of the
time designated in said section.

In force.
|
SEC. 8. And be it enacted,
That this act shall take
effect from the date of its passage.
|
