CHAPTER 252.
AN ACT requiring the Baltimore and Susquehanna Rail
Road Company, where their Rail Road crosses a public
road to cause the said Rail Road to be constructed
over or under the same.

Required to
pass under or
over roads.
|
SECTION 1. Be it enacted
by the General Assembly
of Maryland, That the president and directors of the
Baltimore and Susquehanna rail road company, in constructing
their lateral branch rail roads, shall when
passing in an eastern direction from their main track,
over the Baltimore and Yorktown turnpike road, the
Baltimore and Harford turnpike road, and the Bel Air
road, and when passing in a western direction from
their main track over the Baltimore and Reisterstown
turnpike road, the Liberty road, or the Windsor Mill
road, to to construct their lateral branch roads, as to
pas sunder or over the aforesaid roads, and not over the
surface thereof.

Culverts or
bridges to be
built.

SEC. 2. And be it enacted,
That when the said
lateral branch roads are constructed under the aforesaid
roads, or either of them, there shall be built over such
parts of said rail roads, as pass thereunder, good and
substantial culverts or bridges at the cost of said company,
and be always kept in repair by them sufficient
for the free and safe passage for persons, stock and
vehicles.

Unobstructed
passage way.
|
SEC. 3. And be it enacted,
That when the said
lateral branch rail roads are constructed over the aforesaid
roads, or either of them, they shall be so built as
to assure an unobstructed passage way thereunder.
