Tuesday of June next, to appoint one person, and it
shall be the duty of the school commissioners of said
county, on or before the same day, to appoint one person
who shall proceed, in conjunction, to audit without
delay all the accounts of the said county commissioners
and treasurer of Baltimore county, so far as the same
in any way relate to the said school fund; in the event
of the two auditors thus chosen, being unable to agree,
they are hereby authorised and empowered to select a
third person, whose audit shall be final; and in event
of the said auditors being unable to select a third person,
they are hereby required to communicate the fact
without delay to the judge of the circuit court for Baltimore
county, whose duty it shall be to appoint a third
person, whose audit shall be final, and upon such audit
it shall be the further duty of the said county treasurer,
and he is hereby required, on or before the first day of
July next, to pay to the order of the school commissioners
hereby incorporated, properly attested by the
signature of the president and secretary of said corporation,
all monies found by said audit to be due the said
school fund, and all property, effects, stock or other
evidences of debt, in his possession, appertaining to the
said school fund, the commissioners of Baltimore county
and the school commissioners of said county, are
hereby authorised to pay in equal proportions, to the
said auditors a fair and reasonable compensation for
their services.
Persons to be
appointed to
audit accounts.
     SEC. 5.  And be it enacted, That all the bequests in
and of the school fund of Baltimore county, and all the
real and personal estate of intestates, all State donations,
all fines, penalties, forfeitures and dividends, now by
law made payable to the treasurer of said county, for
the use and benefit of the public schools of said county,
shall, from and after the passage of this act, be directly
paid to the order of the school commissioners of Baltimore
county, incorporated by this act, property attested
by the signature of the president and secretary of said
corporation; exclusive right being hereby vested in the
said school commissioners, to receive all monies from
whatever source arising, dedicated by law for the use
and benefit of the public schools of said county, in the
manner herein prescribed, to be by them disbursed and
employed for the support of public education in said
county; and all laws inconsistent with the provisions of
this act, relating to the public schools or school funds
of said county, be and the same are hereby repealed.
