establish public schools in Baltimore county, and so
much of the second section of the act of eighteen hundred
and thirty-nine, chapter five hundred and thirty-one,
entitled, a supplement to an act entitled an act to
establish public schools in Baltimore county, which
provides for the annual election of said school commissioners,
and is otherwise inconsistent with and repugnant
to the provisions of this act, be and the same
are hereby repealed.
Powers, rights
and privileges.
     SEC. 3.  And be it enacted, That all powers, rights
and privileges lawfully exercised by the present school
commissioners of Baltimore county, by virtue of the
several acts of Assembly, passed in relation to the
public schools of Baltimore county, and all the property
and estate, and effects now vested by law in the said
school commissioners, the treasurer of Baltimore county
and the commissioners of Baltimore county, for the use
and benefit of the public schools of said county, which
are not provided for by the provisions of this act, are
hereby transferred and vested in the school commissioners
for said county, incorporated by this act, a majority
of whom shall hereafter exercise all the said
powers, rights and privileges, and shall perform all the
duties by law to be performed, in relation to the said
public schools; and it shall be the duty of the treasurer
of Baltimore county, and he is hereby required to pay
to the order of the school commissioners incorporated
by this act, properly attested by the signature of the
president and secretary of the said corporation, on the
first Wednesday of each and every month, on account
of school tax authorised by law to be levied in Baltimore
county, the pro rata amount which the public
schools of said county is entitled to of all monies received,
and all credits given on the levy on account of
insolvencies, erroneous assessments, abatements or any
other cause whatsoever, in the ratio that the amount
levied for said public schools is to the whole amount of
the levy.
Duty of Treasurer.
     SEC. 4.  And be it enacted, That for the purpose of
adjusting and finally closing the school fund of Baltimore
county, and of effectually severing all connection
between the said school funds, and the county commissioners
or the treasurer of said county, whether
received or disbursed by said commissioners or treasurer,
arising from State donations, dividends, taxation, or
any other source whatsoever, and of fully transferring
and passing over said funds to the corporation authorised
by this act, it shall be the duty of the county
commissioners of said county, on or before the first
