abet in such assault and battery, shall be fined in
a sum
not less than twenty-five dollars and imprisoned not less
than one month, or the judge of the criminal court of
Baltimore city, or the judge having jurisdiction of the
offence, may, in his discretion, sentence the person so
convicted to confinement in the penitentiary for a period
not less than six months nor more than ten years;
and it shall not be necessary to state with more particularity
than is now requisite in proceedings for assaults
and batteries, the time of place of such assault and
battery in the recognizance or commitment on which
the said person is tried, but the said person may be tried
on a recognizance or commitment for a common assault
and battery, and shall be sentenced by the court according
to the facts proved at the trial of the said person,
and in case the said person is tried upon a presentment
or indictment, it shall only be necessary to allege in the
presentment or indictment, that the offence was committed
between the hours aforesaid, and that it was
committed on a highway in the city of Baltimore or
at a place of public resort or amusement, without setting
forth said highway or place of public resort or
amusement by name.

SEC. 3. And be it enacted,
That all persons confined
in the jail of Baltimore city and county, or in the
jail of Baltimore city in case of the separation of the
jail of said city from the jail of Baltimore county, for
offences punished by confinement in the said jail, shall,
after conviction, be kept occupied and at hard labor in
some useful employment, and that it shall be the duty
of the visitors of the said jail, and they are hereby vested
with the power to frame such regulations as shall be
necessary to the industry, quiet and discipline of the
persons confined in said jail, who may have been convicted
of any offences punishable as aforesaid and ordered
to be confined therein.

SEC. 4. And be it enacted,
That such persons as
shall, after conviction for offences punishable by confinement,
be confined in the jail of Baltimore city and
county, or in the jail of Baltimore city, in case of the
separation of the jail of the said city from that of the
said county, shall be kept separate from such persons
as are in confinement awaiting trial, or for other causes.

SEC. 5. And be it enacted,
That this act shall go
into full force and effect from and after the date of its
