heretofore levied and assessed for the building of
a new
jail in said county, (or any other monies that may be
due said county,) and to adopt all legal and necessary
measures for the recovery of the same.

SEC. 2. And be it enacted,
That on the collection
and receipt of any portion of the said two sums of
money, levied for building a jail, the said commissioners
be, and they are hereby authorised and required to
proceed to contract for, and erect a new jail in said
county, and that for this purpose the said commissioners
be, and they are hereby authorised to select and
appoint a building committee of not more than three
persons, whose duty it shall be to superintend the erection
of the said jail, and the expenditure of the money
levied or to be levied therefor, and generally to do all
other acts appertaining to the erection of the said jail,
which they may be authorised to do by the said commissioners
of Allegany county.

SEC. 3. And be it enacted,
That in addition to the
said sum of three thousand dollars, heretofore levied,
the said commissioners of Allegany county, be, and
they are hereby authorised to levy and assess on the
taxable property of said county, a further sum not exceeding
three thousand dollars, to be expended in the
erection of the said jail, if in their judgment such additional
levy shall be required.

SEC. 4. And be it enacted,
That the act passed at
December session, eighteen hundred and forty-nine,
chapter three hundred and ninety-six, entitled, an act
to rebuild or repair the old jail in Allegany county, and
the act passed at December session, eighteen hundred
and forty-nine, chapter five hundred and two, entitled,
a supplement to ann act entitled, an act to repair or rebuild
the old jail in Allegany county; and also the act
passed at January session, eighteen hundred and fifty-two,
chapter ninety-seven, entitled, an act to repeal an
act entitled, a supplement to an act to rebuild or repair
the old jail in Allegany county, passed at December
session, eighteen hundred and forty-nine, chapter five
hundred and two, and to empower the county commissioners
to levy an additional sum of money to build a
new jail in said county, be, and the same are hereby
repealed.

SEC. 5. And be it enacted,
That the said county
commissioners shall select a site for the erection of said
jail; Provided, however, that it shall be erected upon
the lot at present occupied by the jail, unless some
other suitable and convenient lot can be obtained for
the purpose without cost to the county.
