CHAPTER 129.
An act to confirm the Acts and Proceedings of the Commissioners appointed
by order of the Baltimore County Court, to divide the
Real
Estate of William Price, deceased, of said county, and
for other purposes. |

WHEREAS, It is represented to this General Assembly,
that
an application was made to Baltimore county court at September
term, 1822, to appoint commissioners to divide the real
estate of William Price, late of said county, deceased: And
whereas, a commission did issue to certain persons therein
named, to make division of said real estate, according to the
provisions of the act of assembly entitled, an act to reduce into
system the laws to direct descents, passed at December session,
1820, chapter 191: And whereas, the said commissioners pursuant
to the provisions of said act, did proceed to lay off and divide
the sid lands, and did adjudge and determine that it was capable
of being divided into four parts, and did make a return of
their proceedings as aforesaid to Baltimore county court, at
March term, 1823, which was duly confirmed by said court:
And whereas, Two of the heirs of said Price, to wit:—Jacob
Caples and Samuel Shawl, came into court and elected to take
the said estate so divided into four equal parts, according to the
valuations respectively made thereof by the said commissioners:
And whereas, It has been discovered that the proceedings
of the commissioners in relation to the division of said estate
are erroneous by reason of the said William Price, the intestate
having died anterior to the act of December session 1820, the
provisions whereof are applicable only to persons dying intestate
seized of real estate subsequent to that period: And whereas,
it also appears that the plats and certificates accompanying
said return of the commissioners as executed by one Joseph W.
Jessop, are entirely false and erroneous and the parties interested
likely to suffer thereby: Therefore, |
Preamble. |
Sec. 1. Be it enacted by the General Assembly
of Maryland, That
Richard Hooker, surveyor in said county, be, and he is hereby
authorised, at the instance and request of the commissioners
aforesaid, to make out the plats and certificates of the division
of the real estate of William Price, deceased, specifying particularly,
the number of acres of land in each and every lot so divided,
and return the same when executed and completed to the
commissioners aforesaid, which plats and certificates shall be
returned to the Baltimore county court, by said commissioners,
there to be recorded as a part of the proceedings of the said commissioners |
