            JOSEPH KENT, ESQUIRE, GOVERNOR.

and in lieu of the plats and certificates erroneously
made out and returned by Joseph W. Jessop; which plats and
certificates when so returned and approved by the court shall
be good and available in law, and form a part of the proceedings
of said commissioners.

    Proceedings
confirmed.
    2.  And be it enacted, That the proceedings and return of said
commissioners when corrected, amended and approved as aforesaid
shall be good and available in law and equity to all intents
and purposes and all the acts and proceedings of said commissioners
in relation to the division of the real estate of William
Price, deceased, are hereby declared to be confirmed, and of the
same force and validity as they might or could have been, if the
said Price had died seized of the said real estate subsequent to
the passage of the said last mentioned act of assembly.
    Choice confirmed.     3.  And be it enacted, That the election to take the real estate
of the said William Price, deceased, heretofore made and recorded
in Baltimore county court by Jacob Caple and Samuel
Shawl, two of the representatives of said Price be confirmed
and made valid:  Provided, That the said Jacob Caples and
Samuel Shawl, shall on or before the first day of May next,
give bond and security as required by the act of assembly of December
session 1820, chapter 91, bearing interest from the day
of the date of the said bond or bonds, and in all other respects
comply with the provisions of the above recited act and the
terms specified in said commission.

                                            CHAPTER 130.

An act to authorise the Mayor and City Council of Baltimore to establish
                                      Public Schools in said City.

Power granted
to establish.
    SEC. 1.  Be it enacted by the General Assembly of Maryland,
That the mayor and city council of Baltimore, shall have power
to establish public schools within the city of Baltimore.
    To levy tax
for support.
 
 
 

Proviso.

    2.  And be it enacted, That for the support of the public
schools which may be established by virtue of this act, the said
mayor and city council of Baltimore shall have power to lay and
collect, in addition to the taxes they are now authorised to lay
and collect, such further and other taxes, rates or assessments,
as may be necessary for the support of such pubic schools:
Provided, That a due regard be had to the actual wealth of the
persons who are to pay the same:  And provided also, That all
profits of industry, salary, hire, rents, annuities, the revenue of
property held in trust for minors and others so far as the same
may not now be taxable by law, may be exempted from taxation
except for the support of said public schools.
    Conditional
clause.
    3.  And be it enacted, That nothing in this act contained shall
have any effect and operation in law unless the same shall be
approved of and adopted by the mayor and city council of Baltimore,
at the first session of the city council, which shall take
place after the thirty-first day of December next.
