3. And be it enacted, That an election
for trustees shall be held
on the first Monday in April, eighteen hundred and twenty seven,
and on the first Monday of every succeeding April, at the
said school-house, which said election shall be by ballot, and
conducted as follows, to wit: every subscriber to said institution
shall be allowed one vote for every five dollars by him or
her subscribed and paid, and the three persons having a majority
of votes, shall be declared the trustees for the ensuing year,
Provided, That no person but a subscriber shall be a trustee. |

4. And be it enacted, That for the
purpose of ascertaining
who are entitled to vote for trustees of said institution, the trustees
thereof shall record in a book for that purpose, the names
of all persons who have subscribed thereto, and the amount subscribed
by each of them, and which said right to vote may be
assigned or transferred by a simple transfer or assignment in
writing under the hand of the party, attested by one witness or
more. |

5. And be it enacted, That, John Wampler,
Jacob Yingling,
and William Willis, be and they are hereby constituted and appointed
trustees of the association aforesaid, who shall act until
the time before appointed for the election of trustees; and in
case of the death, resignation or removal out of the county, of
any trustee appointed under this act, or any of their successors,
the remaining trustee or trustees shall forthwith give notice to
the members of the aforesaid association, to assemble within
thirty days from the time of such notification, at the place which
may be designated for holding their elections, who shall then and
there proceed to full such vacancy or vacancies. |

CHAPTER 98.
An act to divorce Elisha Winn and Mary Winn, his wife, of the city of
Baltimore. |

SEC. 1. Be it enacted by the General Assembly
of Maryland,
That the said Elisha Winn, be, and he is hereby divorced from
bed, board, and mutual cohabitation with his wife Mary Winn. |
Authority
and liability
annulled. |
2. And be it enacted, That the said
Mary Winn, shall not by
virtue of her marriage with the said Elisha Winn, be authorised
to have or claim any right or interest in the estate real, personal
or mixed, of the said Elisha Winn to be by him acquired after
the passage of this act, nor shall the said Elisha Winn, be
liable for any debts which may be contracted by the said Mary
Winn, after the passage of this act. |
