LAWS OF MARYLAND.

 

sums as the president and managers thereof may

 

from time to time deem requisite; and also to

 

secure the payment of the principal and interest

 

of any bonds so issued by mortgage of their prop-

 

erty or franchises, or both.

 

SEC. 2. And be it enacted, That the president,

 

managers, and company of the Baltimore and

 

Yorktown Turnpike Road be and they are hereby

 

authorized, in their discretion, to grant to any owner

or owners of land, bounding on the said turnpike
road, permission to construct or lay upon the said

 

road, in front of such land, a pavement or other

 

footing, not more than thirteen feet wide, and with

 

or without a curb of stone or wood, upon such

 

terms and conditions, and subject to such regula-

 

tions as the said corporation, or the president and

 

managers thereof, may prescribe ; and also to allow,
subject to such regulations and conditions as the

trees within the space occupied by such footing ;

 

provided however, in case any such permission

 

shall be granted, the person obtaining the same

SEC. 3. And be it further enacted, That the presi-

 

dent, managers and company of the Baltimore and

 

Yorktown Turnpike Road be and they are here-

to the County Commissioners of Baltimore county,

 

upon such terms and conditions, and with such

 

reservations as may be mutually agreed upon be-

 

tween the parties, any portion or portions of their

 

turnpike road, for use, as a public highway, re-

 

serving to the said president, managers and com-

 

pany of the Baltimore and Yorktown Turnpike

 

Road all railway rights, privileges and franchises
now possessed, or hereafter to be acquired by

 

them, over or upon any road bed so ceded.

 

SEC. 4. And be it enacted, That all acts or parts
