CHAPTER 394.
|
 
|
AN ACT giving the sanction of the General Assem-
|
 
|
bly of Maryland to a deed or conveyance to be made
|
 
|
by John W. Kennedy, trustee, or by the heirs of
|
 
|
James W. Kennedy, or by the heirs of Hugh
|
 
|
Kennedy, or of any one of them, of certain lots
|
 
|
of ground in Hagerstown, Maryland, to the Trus-
|
 
|
tees of the Presbyterian Church in Hagerstown.
|
 
|
Whereas Hugh Kennedy, of Washington county,.
|
 
|
deceased, by the last will and testament devised and
|
 
|
bequeathed to the officers and congregation of the
|
 
|
Presbyterian Church of Hagerstown, all his right,
title and interest to a lot of ground and buildings
|
 
|
known on the plat of said town as lot number two
|
 
|
hundred and thirty-one, and also ten or twelve feet of
|
 
|
ground on the south side of said lot ; and whereas
|
Preamble.
|
John Kennedy, by deed, dated seventeenth June,
|
 
|
eighteen hundred and thirty-five, conveyed all his
|
 
|
right, title and interest in said property and premises
to John W. Kennedy and James Kennedy, in trust,
|
 
|
that they should hold the same for the use of the
|
 
|
said Presbyterian Church of Hagerstown, and when
|
 
|
the same was incorporated should convey said prop-
|
 
|
erty, right and interest in the same, to the said Pres-
|
 
|
byterian Church.

|
SECTION 1. Be it enacted by the General Assembly
|
Sanction
|
of Maryland, That sanction is hereby given to the
|

deed or conveyance which really be made to the
|
 
|
Presbyterian Church of Hagerstown of the property
mentioned in the deed of John Kennedy, dated sev-
|
 
|
enteenth June, eighteen hundred and thirty-five, and
|
 
|
of record among the land records of Washington
|
 
|
county, Liber R. R., folio sixty-eight to seventy, by
|
 
|
the trustees, or either of them, mentioned in said
|
 
|
deed, or by the heirs at law of the said John Ken-
|
 
|
nedy, or by any trustee or person appointed by a
|
 
|
court of equity or otherwise, to make such deed or
|
 
|
conveyance ; provided, however, and the acceptance
|
 
|
of the sanction of the General Assembly of Mary-
|
 
|
land hereby given, or the exercise of any power
|
 
|
given by this act, or the making of any such deeds,
