Laws of Maryland, title "Anne Arundel County," sub-title

" Oysters," to be designated as section 188 A, and section 188
|
|
|
|
B, and to read as follows :.
|
|
|
|
188 A. Any resident of Anne Arundel County desiring to
|
|
|
|
use any canoe or other boat in catching, or taking oysters
|

for sale, or for any other purpose, with rakes or tongs, in any
|

of the waters of said county, shall first obtain a license there-
|

fore by application to the clerk of the Circuit Court for said
|
|
|
|
county, and such license shall have effect from the fifteenth
|
|
|
|
of September in the year of its issue to the twentieth day of
|
|
|
|
April inclusive next succeeding ; provided, however, that
|
|
|
|
such license shall not authorize the use of said canoe or boat
|
|
|
|
in taking or catching oysters on the natural bed or beds in
|
|
|
|
the waters of Severn River, nor in any creek, cove, arm or
|
|
|
|
inlet of Severn River in said county, above a line drawn in
|
|
|
|
a northeasterly direction from the wharf of the United States
|
|
|
|
Ship Lantee at the United States Naval Academy to the
|
|
|
|
north bank of said river immediately opposite said wharf ;
|
|
|
|
for the period of two years from the first day of September
|
|
|
|
1892, and provided further that all such licenses shall be
|
|
|
|
granted in the same manner and upon the same terms and
|
|
|
|
conditions as provided in article seventy-two of the Code of
|
|
|
|
Public General Laws of Maryland, title " Oysters," sub-title
|
|
|
|
"Tonging."

|
|
188 B. If any person shall use any canoe or boat not
|
|
|
|
licensed as required upon the same terms and conditions, as
|
|
|
|
provided in article seventy-two of the Code of Public General
|
|
|
|
Laws of Maryland, title "Oysters," sub-title "Tonging."

|
|
|
188 B. If any person shall use any canoe or boat not
|
|
|
|
licensed as required by the preceding section in taking or
|

catching oysters with rakes or tongs in the waters of Anne

Arundel County or if any person having such license, shall
|
|
|
|
take or catch any oysters with rakes or tongs on the natural
|
|
|
|
beds or bars in the waters of Severn River or of any creek,
|
|
|
|
cove, arm or inlet thereof, above the said line drawn from
|
|
|
|
the Lantee's Wharf to the opposite bank of the Severn River
|
|
|
|
as provided in the preceding section, he shall, upon convic-
|
|
|
|
tion thereof before any justice of the peace of said county,
|
|
|
|
or in the Circuit Court for said county, be fined not less than
|
|
|
|
twenty dollars nor more than one hundred dollars, and in
|
|
|
|
case of refusing to pay said fine, and cost of prosecution, the
|
|
|
|
said party shall be confined in the Maryland House of Cor-
|
|
|
|
rection for three months ; and in all cases under this section
|
|
|
|
the accused shall have a right of appeal from the justice of
|
|
|
|
the peace to the Circuit Court for the said county, provided
|

that nothing in this act shall be construed to prevent per-
