cester County ; one company in Brooklyn, Anne Arundel


County, and one company in Cambridge, and the following


six companies in Baltimore City : Howard Zouaves No. 1,


Howard Zouaves No. 2, the Waverly Guard, the Woodberry


Guard, the Monumental City Guard, and the Baltimore Rifles,


and the Fifth Regiment shall have power and authority to


enlist and recruit two new companies when permitted by the


commander-in-chief , and the fourth battalion may be formed


into a regiment to be called the fourth regiment, wheu author-


ized by the commander-in-chief, to the number of not


exceeding twelve companies, either by assignment of com-


panies already existing or by enlisting such new companies


as the commander-in chief may permit, and direct aud the


first regiment secoud battalion and third battalion shall


consist of such companies as they now have or as they may be


formed into by assignment of companies to them and from


them by the commander-in-chief, provided the integrity of


the second battalion shall not be impaired or destroyed


so long as said battalion shall maintain its efficiency in


numbers and orgauizations as now required by law, and


that the whole brigade shall not consist of more than forty


companies as aforesaid, and provided further, that the
