the name of the State of Maryland against such person or


persons so charged on oath as offending, and shall issue his


warrant to some one of the constables, or sheriff of said


county, for the arrest of the party or parties, with the boat,


nets, and other fixtures used in such violation of this act,


to be brought before said justice, who shall be a resident of


said election district, and upon conviction shall forfeit and


pay the sum of twenty dollars and costs, or shall be com-


mitted to the county jail by said justice of the peace, for a


period of not more than thirty days, and shall also forfeit


the nets, boats and other fixtures used in such violation,


and the boats, nets and other fixtures captured and con-


demned under the provisions of this act, shall immediately


-be advertised by printed or written hand-bills, and sold to


the highest bidder for cash in ten days thereafter, and the


money arising from said sale and fines, after deducting the


legal costs, shall be paid, one-half to the informer and the


other half to the school fund of said county, and in default


of payment of such fine and costs such person or persons


convicted, he or they, shall be sentenced to the county jail


for not less than ten or more than thirty days, in the dis-


cretion of said justice of the peace ; provided nothing herein


contained shall prevent any person, who may feel aggrieved

to the Circuit Court of Harford County, if such appeal is


taken and satisfactory bond filed of not less than one hun-


dred dollars, for prosecuting said appeal with the justice of


the peace, within five days after the fine is imposed, and


the boats, nets and other fixtures are condemned.


SEC. 4. And be it enacted, That this act shall take effect


from the date of its passage.

AN ACT to repeal section 31 article 22 of the Code of
Public Local Laws, title " Washington County " sub-title
" Birds and Game " and to re-enact the same with amend-
ments.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That section 31 of article 22 of the Code of
