658 LAWS OF MARYLAND.

drain running northward from its intersection with the
Town Run Drain at the Franklin House stable to the Oak
Spring, two hundred feet in length; one drain running
northward from Franklin House stable through the alley
between Washington and Franklin streets to an alley
running north and south between Jonathan street and
Walnut street, one thousand feet in length; one drain
known as the south end drain, beginning at the alley
running east and west in the rear of the Court House, and
running south one hundred feet east of Potomac street
intersecting the Marsh Run, four thousand feet in length ;
one drain connecting with the west end drain on the
property of J. B. Thurston, and running westward between
Walnut street and Foundry street to Church street, one
thousand feet in length; one drain beginning at Walter
Hutching's property on West Washington street and
running thence in a northerly direction three hundred and
thirty-five feet; provided, that to each and every drain
hereinbefore named and designated the sum of two dollars
and twenty-one cents per linear foot according to distance
hereinbefore set forth, shall be appropriated to be applied
and used exclusively upon each of the hereinbefore named
drains upon the basis of the lengths hereinbefore set forth;
provided, that if any drain hereinbefore named and desig-
nated shall be fully constructed at a cost of less than said
sum of two dollars and twenty-one cents per linear foot,
then the unexpended balance or surplus from said drain
shall be appropriated to the completion of any drain here-
inbefore named and designated if there shall be found to
be a deficiency in the sum appropriated for the completion
of any of said drains; and second thirty thousand dollars
dollars thereof shall be appropriated and used exclusively
for the following purposes, and in the following manner
to wit; three thousand dollars of the sum of thirty thousand
dollars, last above mentioned, shall be used and applied
exclusively to the liquidation and payment of judgments
now recorded against the mayor and council for and on
account of damages incurred in condemning, laying out,
and opening Church street west of High, Locust street,
between North and Broadway streets, and South Mulberry
street extended, south of Baltimore street and such other
judgments that may hereafter be entered against the said
mayor and council for and on account of condemning, laying
out, opening, widening, altering or changing any street, lane,
alley, water course or drain so far as said sum shall be
adequate, and twenty-seven thousand dollars of said sum of
thirty thousand dollars, last above mentioned, shall be used
and applied exclusively to grade and macadamize such
