or any court trying the case, be committed to any reforma-


tory institution provided by law, and authorized to receive


the same for such period as the justice of the peace or court


may determine, not to exceed two years.

Effective.

SEC. 2. And be it further enacted, That this act shall


take effect from the date of its passage.

CHAPTER 398.


AN ACT to create a commission to inquire into the distri-


bution of the State school tax, and to make a report to-


the next General Assembly of Maryland.


WHEREAS, it is complained that there are gross inequali-

ties in the distribution of State school tax in consequence


of which a number of counties in the State with a low rate


of county school tax, are able to have ten months school in


the year and pay their at a high rate of compensation per


term, and other counties, with a high rate county school tax,


are able to have only from five to seven and one -half months


school in the year, and pay their teachers at a low rate of


compensation per term ; and


WHEREAS, the subject is intricate the interest involved

are important and extensive, and the difficulties in the way


of adjusting the alleged inequalities are peculiar, both in


magnitude and character, making it necessary that in deal-


ing therewith thorough investigation, full knowledge and1


mature deliberation should be had ; therefore,


SECTION 1. Be it enacted by the General Assembly of

Maryland, That the Governor of the State shall immediately

after the passage of this act appoint five persons, one of


whom shall be a resident of the Eastern Shore, one of south-


ern Maryland, one of Baltimore City, and the other two of


central and western Maryland, respectively, who shall con-


stitute a commission to be called "The Maryland School


Tax Commission," said commissioners shall hold office for


two years from the date of their appointment, and shall


serve without compensation beyond their actual expenses;


incurred in attending the meetings of said commission


making the investigation required of them ; the Governor


may at any time remove any of the said commissioners for


neglect of duty or misconduct in office, and appoint others.
