CHAPTER 396.


AN ACT to repeal the act passed at the January session


eighteen hundred and seventy-eight, chapter three hun-


dred and fifty -three, as codified in the Code of Public


General Laws, article twenty -seven, title " Crimes and


Punishments" sub-title "House of Refuge," section


three hundred and fifty-three, and to re-enact the same


with amendments.


WHEREAS, the act passed at the January session eighteen

hundred and seventy -eight, chapter three hundred and


fifty-three, reduced the number of managers of the House


of Refuge below the number provided by law, prior to said


act : and whereas the corporation, the House of Refuge,


refused to accept the provisions of said act, and whereas


said act was not considered operative, and was not acted


upon by the members of said corporation, the House of


Refuge, nor by the mayor and city council of Baltimore,


nor by the successive governors of the State after the pas-


sage of said act, all of whom continued to elect or appoint


the managers of said House of Refuge in accordance with


the provisions of the law, existing prior to the passage


of said act, and whereas doubts have arisen since the


adoption of the Code of Public General Laws of the year


eighteen hundred and eighty-eight in which the said act


of eighteen hundred and seventy-eight, chapter 343 was


codified, as to whether the said section three hundred and


fifty-three of article twenty- seven of the Code of Public


General Laws, is now operative ; therefore in order to


remove all doubts in reference thereto.


SECTION 1. Be it enacted by the General Assembly of
