General Laws of Maryland ; provided, however, that when-

ever land is to be condemned for any part of its route which


is now within the corporate limits of Baltimore City, the


application shall be made to a justice of the peace of Balti-


City, who shall issue his warrant to the sheriff of Baltimore


City, who shall return the inquisition to the Circuit Court


of Baltimore City, instead of to the corresponding officers


and Court of Baltimore County.


SEC. 4. And be it enacted, That it shall not be lawful


for the said Baltimore, Hampden and Lake Roland Railroad


Company (either before or after its completion) to con-

solidate with, lease or purchase, or to lease or sell


its property and franchises to any railroad company


heretofore, or hereafter incorporated under the laws of this


State, whose railroad shall connect with or form a contin-


uous line with the railroad of the said Baltimore, Hampden


and Lake Roland Railroad Company as above authorized to


be constructed ; provided, however, that the agreement for


such consolidation, lease, sale or purchase, shall be sub-


mitted to the stockholders of both of said corporations at a


special meeting, called for considering the same, and shall


be sanctioned by the holders by a majority of the outstand-


ing stock of each of said corporations, and if sanctioned at


such meeting, the said agreement shall be filed in the office


of the Secretary of State of Maryland ; and in the event of


a consolidation of the said Baltimore, Hampden and Lake


Roland Railroad Company under this power, the agree-


ment of consolidation shall state the capital stock of the


consolidated company, its corporate title, the number of its


directors, the method of exchanging the stock of the con-


solidated company for the stock of the constituent compa-


nies and a method of valuing the shares of stock of such


stockholders of either of said constituent companies who


refuse to make such exchange and to secure to such stock-


holders the fair value of their said stock, and shall prescribe


such other terms and conditions for the management of said


consolidated corporation as may be thought proper ; and the


said consolidated corporation is liereby authorized to mort-


gage its property and franchises to secure negotiable bonds


to an amount not exceeding its authorized capital stock, as


fixed by said agreement, or as afterwards increased in the


manner provided in article twenty-three, section one hun-


dred and sixty-five of the Public General Laws of Maryland.


SEC. 5. And be it enacted, That the said Baltimore,
