CHAPTER 65.


AN ACT to repeal section one hundred and ninety one of


Article twenty two of the Code of Public Local Laws en-


titled "Washington County," sub -title "Hagerstown,"


and to re-enact and amend the same.


SECTION 1. Be it enacted by the General Assembly of


Maryland, That section one hundred and ninety-one of

Repealed

Article twenty-two of the Code of Public Local Laws, entitled


"Washington County," sub-title "Hagerstown," be and the


same is hereby repealed and re-enacted so as to read as fol-


lows.


191. The said board of street Commissioners shall have


control of the lighting of the town, with power to provide

the material, employ lighters and other necessary labor, and

town

to make all needful provisions therefor, and to make such


changes or alterations as from time to time they may deem


proper or necessary, with the power to contract with any


person, corporation or association for such lighting ; pro-


vided, that the cost under any such contract or lighting shall


not exceed the sum of six thousand dollars for any one year


nor shall such contract be made for a period exceeding ten


years ; and to provide the sum of money necessary to pay


the cost or charge under any such contract or lighting, the


mayor and council are hereby authorized and required, an-

nually to levy on the assessable property of the town ten

cents on every one hundred dollars worth of assessable prop-


erty and the sums of money collected upon said levy shall


constitute a separate fund to be kept by the collector of


taxes, and to be applied to the payment of such cost or


charge under said contract or lighting and to and for no


other use or purpose — said fund to be placed and drawn


out by said board of street Commissioners as directed by


section 167 of said charter ; and in case the said levy should


not be sufficient to pay the cost of such contract or lighting,


the mayor and council is hereby authorized and required


to levy and appropriate, of the thirty cents of tax authorized


by section 195 and not otherwise specifically appropriated


by said section, as much thereof as may be necessary for the


purpose of raising the amount to be paid under any such


contract or lighting, and the said sum of money so collected


from said tax as aforesaid, appropriated or levied with the


sums received from pro rata apportionment to the same, as


provided by section 166, shall constitute a separate fund to


be kept, applied and drawn in the same manner and form as


the sums collected from the said taxes of ten cents.
