force shall arrest any person or persons found violating any of the


provisions of this act, and take them at once before a justice of


the peace of said county to be dealt with as hereinafter provided;

Arrests.

every person using any boat, canoe or vessel in taking and catching


crabs with scrape, drags, dredges or similar instruments in the


waters of said county, shall exhibit to the sheriff and constables


of said county and to the officers of said fishery force the license


used hereunder for the use of said boat, canoe or vessel when


called upon by any of said officers to do so.


SUB-SEC. 7. Any owner or owners of any boat, canoe or vessel,


who shall use or allow the same to be used in taking and catch-


ing crabs with scrape, drag, dredges or similar instruments in


the waters of said county, without first having obtained a license


therefor as hereinbefore provided, or any owner or owners of any


boat, canoe or vessel who shall use or allow the same to be used


in taking and catching crabs as aforesaid in the waters of said


county, when said boat has not been owned in whole by residents
of said county for the six months next preceding, provided, said


boat, canoe or vessel is six months old; or any owner or owners of


any boat, canoe or vessel who shall use, or allow the same to be


used in taking and catching crabs as aforesaid in the waters of


said county, when said boat, canoe or vessel has not been owned


in whole by a resident of said county, from the time of the con-


struction and completion of said boat, canoe or vessel, provided,


said boat is less than six months old; or any owner or owners of

any boat, canoe or vessel who shall allow the same to be used in

county, the Great Choptank river excepted, by any person or per-


sons, except bona fide residents of Dorchester county, who. have


resided therein for the term of twelve months next preceding; or


any owner who shall have fraudulently obtained a license under


this act to use his boat, canoe or vessel in taking and catching


crabs with scrapes, drag, dredge or other similar instruments in


the waters of said county, shall be deemed guilty of a misde-


deanor, and upon conviction thereof in the circuit court for Dor-


chester county or before a justice of the peace of said county, shall


be sentenced to pay a fine not less than fifty dollars, nor more than


one hundred dollars, and costs of prosecution, and stand com-


mitted to the county jail until such fine and costs are paid, or


until discharged therefrom in due course of law, and all fines


arising from any violation of this act, shall be paid by the defen-


dant or defendants unto the justice of the peace trying said case,


or to the sheriff of said county when the same is imposed by the


circuit court for said county, and by them to be paid unto the


school commissioners of said county for the public school of said


county, and a failure by the said justice or sheriff to pay said fine


within thirty days after receipt of the same to the said school


commissioners shall be deemed a misdemeanor, and shall subject
