after the sale thereof, the said person or firm shall be confined


in the house of correction not less than two nor more than four


months; provided, that if the person or persons so convicted shall


before sentence tender the payment, and pay such fine as the court


or justice may direct, not less than one hundred nor more than two


hundred dollars, the court or justice may sentence such person


or persons to be imprisoned in the county jail of said county


instead of the house of correction, for not less than two nor


more than four months; and, provided, further, that if any
