the provisions aforegoing in regard to elections; in case of va-


cancy in the office of mayor or councilmen, by death, resignation


or removal from the town, said vacancy shall be filled by a vote


of the council, until the next election for members of the council.


SEC. 12. The council shall have power to pass all ordinances


necessary for the good government of the town, may open, close


and widen streets, lanes and alleys; prevent, remove and abate or


cause to be removed or abated all nuisances or obstructions in or


upon the sidewalks, streets, highways, lanes or alleys, drains or


water courses, or in or upon any lot adjacent thereto, and to pro-

vide for imposing a fine upon any person causing, creating or

maintaining any such nuisance or obstruction; to remove or cause


to be removed houses or other structures, or objects that may be


dangerous to property, health or persons passing along or over


any of the highways of the toAvn or residing in the neighborhood


thereof; to make reasonable regulations in regard to buildings to


be erected in said town; to make and establish grades upon the


streets and highways of the town; to cause sidewalks along the


public streets and highways of said town to be graded, paved, re-


paired or made, curbs to be set and gutters to be laid; to cause


the water courses, drains or sewers to be paved, kept in repair


and cleaned; to control and protect the public grounds and


property of the town; to establish and regulate a station house


or lock-up for the confinement of the violators of the laws and


ordinances of the town; provided, that the county jail shall


be used for such purpose until said council shall deem it advisa-


ble to establish and regulate said station house or lock-up; to levy


a tax and impose a license on dogs or other animals running at


large; to prevent horses, cattle and swine from running at large

commodities; and to prohibit hog-pens and slaughter-houses


within the town limits; and for the purpose of carrying out the


foregoing powers, and for the preservation of the cleanliness,


health, peace and good order of the community, and for the pro-


tection of the lives and property of the citizens, and to suppress,


abate or discontinue or cause to be suppressed, abated or discon-


tinued all nuisances within the corporate limits of said town, they


may pass all ordinances or by-laws from time to time necessary,


and to insure the observation of such ordinances, in addition to


an action of debt or such other civil remedies as may exist in such


cases by law for the recovery of the penalties thereunto affixed,


they may affix thereto such reasonable fines, not exceeding fifty


dollars in any case, as to them may appear right, and in default


of the payment of any fine imposed they may provide for the im-


prisonment of the offender for a period not exceeding thirty days


or until the fine is paid.
