SEC. 4. The council shall meet at some convenient place in said
|
|
|
|
town on or before the first Monday in Septemher next succeeding
|
|
|

their election, and as often thereafter as may he necessary to dis-

charge the duties of their office, not less, however, than once in
|
|
|

every three months.

SEC. 5. The mayor shall preside at all meetings, and shall:

call such meetings from time to time as he may deem neces-
|

sary, but in the event of the absence of the mayor at any meet-
|

ing the members of the council present shall elect one of then
|
|
|
|
number to preside during his absence, who shall for the time
|
|
|

being, be clothed with all the powers and authority of said mayor ;

|
a majority of the council shall constitute a quorum for the
|
|
|
|
transaction of business, and the council shall pass rules and by-
|
|
|
|
laws for their own government while in session.

|

SEC. 6. Neglect or non-user shall not work a forfeiture of this
|
|
|
|
charter.

|
|
SEC. 7. The council shall annually appoint a clerk, who shall
also be treasurer, who shall keep minutes of its proceedings in
|
|
|

a well bound book which shall be open to the inspection of all
|
|
|
|
persons interested therein, and shall record in a similar book all
|
|
|
|
ordinances passed by the council, and the mayor shall sign his
|
|
|
|
name to all ordinances as recorded, and the clerk shall attest his
|
|
|
|
signature; and the clerk shall discharge such other duties as the
|
|
|
|
council may require; the said council shall also annually appoint
|
|
|
|
a bailiff a,nd such under bailiffs and other officers as may be
|
|
|
|
deemed necessary.

|
|
SEC. 8. The council shall allow their clerk and bailiff and other

|
|

officers such compensation for their services as may be deemed
|
|
|
|
reasonable.

|
|
SEC. 9. The council and other officers of the corporation before
|
|
|

they enter upon the duties of their respective offices, shall take
|
|
|
|
an oath that they will diligently and faithfully discharge the
|
|
|
|
duties of their office, without favor, partiality or prejudice.

|
SEC. 10. The clerk and bailiff shall give bond to the mayor
|
|

and council of Brunswick in such penalty and with such securi-
|
|
|
|
ties as may be required, conditioned for the faithful performance
|
|
|
|
of the duties of the office of clerk and bailiff, respectively, and
|
|
|
|
the said bond shall be recorded in the office of the clerk of the
|
|
|
|
circuit court for Frederick county.
|

|
|
SEC. 11. The council shall receive all election returns and de-
|
|
|
|
termine all questions arising thereon, and any person conceiving
|
|
|

himself aggrieved by reason of such decision may appeal to the

circuit court for Frederick county, which shall hear and deter-
|

mine the same and determine who shall pay the costs of appeal ;

in case of a tie in any election for mayor and members of council,
