CHAPTER 170.
|
|
|
|
AN ACT to repeal sections thirty-one, thirty-two and thirty-
|
|
|
|
three, of article nineteen, of the Code of Public Local Laws of
|
|
|
|
the State of Maryland, entitled "St. Mary's county," sub-title
|
|
|
|
"County Commissioners," and re-enact the same with amend-
|
|
|
|
ments.
|
|
|
|
SECTION 1. Be it enacted by the General Assembly of Maryland,
|
|
|
|
That sections thirty-one, thirty-two and thirty-three, of article
|
Repeal
|
|
|
nineteen, of the Code of Public Local Laws, entitled "St. Mary's
|
|
|
|
county," sub-title "County Commissioners," be and they are hereby
|
|
|
|
repealed and re-enacted to read as follows :
|
|
|
|
31. They are authorized and directed at their first meeting after
|
|
|
|
their election and qualification and not later than the year eigh-
|
|
|
|
teen hundred and ninety-one and thereafter, to elect by a majority
|

|
vote a clerk to said board who by virtue of such election, shall
|
|
|
|
shall also be treasurer and who shall serve as such for the term
|
|
|
|
of two years and until his successor is elected and qualified.
|
|
|
|
32. That such person being elected as aforesaid shall give bond
|
|
|
|
to the State of Maryland in the penalty of five thousand dollars,
|
|
|
|
with security to be approved by the county commissioners, for the
|
|
|
|
true and faithful performance of his duties, which bond shall be
|
|
|
|
liable for any default by him or misappropriation of any of the
|
|
|
|
county's or State's money or funds entrusted to him, and shall be
|
|
|
|
recorded in the office of the clerk of the circuit court for said
|
|
|
|
county; and the county commissioners of said county may enter
|

|
action or actions on said bond for any such default or misappro-
|
|
|
|
priation of funds belonging to said county, and said bond may be
|
|
|
|
also liable to the State of Maryland for any misappropriation of
|
|
|
|
State's funds or default in the payment thereof; and for the
|
|
|
|
performance of both clerk and treasurer, he shall receive an an-
|
|
|
|
nual compensation of not less than five hundred dollars nor
|
|
|
|
more than six hundred dollars, in the discretion of said county
|
|
|
|
commissioners.
|
|
|
|
SEC. 2. And be it enacted, That this act shall take effect from
|
