CHAPTER 149.


AN ACT to repeal chapter one hundred and thirty-nine, passed


at the January session of the General Assembly eighteen hun-


dred and eighty-four, entitled an act to prevent the hunting or


collecting, trapping, capturing, taking, killing or destroying in


any manner terrapins or terrapin eggs in Somerset county,


during the months of May, June, July and August, and to re-


enact the same so as to read as follows :


SECTION 1. Be it enacted by the General Assembly of Maryland,

Repeal.

That chapter one hundred and thirty-nine, passed at the January


session eighteen hundred and eighty-four of the General Assem-


bly of Maryland, be and the same is hereby repealed and re-enacted.


so as to read as follows :


SEC. 2. Be it enacted, That no person shall hunt, catch, trap,


capture, take, kill or destroy in any manner within the limits of


Somerset county in this State, any terrapins or terrapin eggs dur-


ing the months of April, May, June, July, August or September

in any year, nor shall it be lawful under the provisions of this


act to hunt, catch, trap, capture, take, kill or destroy in any man-


ner within the limits of said Somerset county at any time during;


the year, any terrapin which measures less than four inches and


a-half on the bottom or underneath shell.


SEC. 3. And be it enacted, That if any person hunting, catch-


ing, trapping, capturing, taking, killing or destroying in any man-


ner, terrapin or terrapin eggs during the months of April, May,


June, July, August or September in any year as aforesaid, or if


any person shall hunt, catch, trap, capture, take, kill or destroy


in any manner within the limits of said Somerset county at any-


time during the year, any terrapin which measures less than four


inches and a-half on the bottom or underneath shell, contrary to

the provisions of this act, shall be guilty of a misdemeanor, and

upon conviction thereof before any justice of the peace of said


county, shall be punished by a fine of not less than twenty-five


dollars nor more than fifty dollars and shall stand committed to


the jail of Somerset county until said fine and costs are paid; the


one-half of said fine shall be paid to the informer and the other


half to the school fund for Somerset county, but whenever any


person shall be convicted under the provisions of this act before


any justice of the peace as aforesaid, the person or persons so con-


victed shall have the right to appeal to the circuit court for said


county, and if the said judgment should then be affirmed by the


court aforesaid, like penalties as hereinbefore set forth shall be


imposed, and all costs shall be imposed on said offender, and he


shall be committed to the jail aforesaid until said fine and costs


are paid.
