SEC. 4. And be it enacted, That the possession by
|
|

any person of any of the birds, ducks or game men-

|
|
|
|
tioned in the preceding sections, during the time
|
|
|

when the shooting, killing, taking, trapping, catch-

be deemed prima facie evidence of the guilt of the

person or persons possessing the same ; provided,

however, that nothing contained in this act shall be

construed so as to prevent any person from killing

|
the birds herein mentioned when found upon his,
|
|
|
|
|
her, or their own premises.

|
SEC. 5. And be it enacted, That no person shall

SEC. 6 And be it enacted, That the several jus-
|
|
|
|

tices of the peace in and for Wicomico county are
|
|
|
|
|
hereby given full and sufficient authority and juris-
|
|
|
|
|
diction to hear, try and determine all cases which
|
|
|
|
|
may arise under the provisions of this act ; and the
|
|
|
|
|
said justices of the peace shall impose the tines pro-
|
|
|
|
|
vided for in this act, together with all the costs of
|
|
|
|

the prosecution upon all persons who, after a fair

trial, shall be adjudged guilty of a violation of the
|

|
|
|
provisions of this act; and if any person or persons
convicted as aforesaid shall be in default of payment

of any fines or costs imposed under this act, the said
|
|
|
|
|
justice of the peace shall immediately commit the
|
|
|
|
|
said person or persons, so defaulting, to the county
|
|
|
|
|
jail in Baid county, to be there confined until said
|
|
|
|
|
fines and costs are paid in full.

|
|
|
|
SEC. 7. And be it enacted, That it shall be the
|
|
|
|
|
duty of all the bailiffs and constables in the several
|
|
|
|
|
towns and election districts in Wicomico county to
|
|
|
|

arrest forthwith all persons whom they may see or

rest

hear of violating any of the provisions of this act,
|
|
|
|
|
and to take them before the nearest justice of the
|
|
|
|
|
peace in said county, to be dealt with in accordance

with this act.

Effective.

SEC. 8 And be it enacted, That all parts of acts

inconsistent with the provisions of this act be and
