trains about to cross the same, both day and night ;


and if said railway company shall fail, neglect or


refuse to comply with the provisions of this section,


it shall be liable to a fine of not less than ten nor


more than twenty dollars for each and every day of


failure, neglect or refusal to comply with the provi-


sions of this section, to be collected as small debts


are now collected under the laws of this State.


SEC. 21. And whereas the said Baltimore and


Delta Railway Company, nuder a decree of the Cir-


cuit Court for Baltimore county, sitting as a court of


equity, has purchased all the property, rights, priv-
ileges and franchises of the Maryland and Pennsyl-


vania Railroad Company, and said sale has been


duly reported to and ratified by said court; but


doubts have been expressed as to the sufficiency of

said sale to pass a valid title to the purchaser with-

out the sanction and consent of the General Assem-

en.

bly of Maryland; therefore be it enacted by the Gen-


eral Assembly of Maryland, that the consent of the


State of Maryland to said sale is hereby given ; and


that the said Baltimore and Delta Railway Company


be, and is hereby authorized to have, hold, enjoy and ex-


ercise the property, rights, privileges and franchises of
the said Maryland and Pennsylvania Railroad Compa-


ny, purchased by it under the decree of the Circuit
Court for Baltimore county, as fully as the same were


held, owned and enjoyed by the said Maryland and


Pennsylvania Railroad Company.


SEC. 6. And be it enacted, That this act shall take
