CHAPTER 453.


AN ACT to repeal chapter two hundred and twen-


ty-five, passed at the January session, eighteen


hundred and seventy-two, entitled " An act to -


regulate the trial fees of the State's Attorney for


Wicomico county, and to re-enact the same so as


to read as follows :


SECTION 1. Be it enacted by the General Assem-


bly of Maryland, That in all civil or criminal cases


where the State's Attorney for Wicomico county


appears and tries cases, when it is his duty to ap-


pear and try cases as now may be, or may hereafter


be prescribed by law, any judge of the first judicial


circuit of Maryland, may, in his discretion, allow such


additional fees to the State's Attorney of said coun-

ty, in addition to what is now allowed by law, in


each and every case, as the said judge may think


just and proper, to be levied by the county com-
missioners of said county; provided that no addi-


tional fees shall bo allowed when the total appear-


ances and trial fees allowed by law to said State's


Attorney amount to the sum of one thousand dol-


lars in any one year; and provided further, that


this act shall not be so construed as to include the


fees and commissions of the said State's Attorney al-


lowed and paid by the State of Maryland.


SEC. 2. And be it enacted, That the State's At-


torney for Wicomico county shall be ex-officio coun-


sel to the board of county commissioners of said


county; that he shall appear and try or defend in


all cases, civil or criminal, where the said county is


interested as plaintiff or defendant, except in cases
