shall not be demanded of the examiners within sixty


days after the receipt of the same, they shall make


application in the usual manner to have said balance


deposited in the Circuit Court for Baltimore county,
and all expenses of such proceedings shall be paid


out of the said balance ; provided that nothing in
this section contained shall prevent the- examiners

from receiving such amount as may be assessed in


different sums and installments where the sums are


paid voluntarily, and the said examiners shall deem


it advisable to receive such installments ; but if any


portion of the amount of assessment should be paid,


and the person or persons who are legally entitled to


pay the assessment should refuse the balance, then


said balance shall be collected in the manner herein-


before provided for ; and whenever any assessment


is collected, or any portion of the same shall be re-

cheque, order or warrant of the examiners depositing


the same and having charge of the proceedings in


the matter. When said avenue shall be completed,


and all the costs, charges and expenses of the same


have been paid, and should there be a balance of the


assessments for benefits on hand, the amount pf such


balance shall be refunded pro rata to the parties


who have paid in the same.


SEC. 6. And be it enacted, That as soon as the


proceedings of the examiners shall be ratified and


confirmed, and the gross amount to be collected is


so ascertained, and before the collection of any such


assessments, each of said examiners shall give bond

tioned for the faithful execution of their trust, and


their said bond shall be subjected to the approval of


the County Commissioners of Baltimore county, and


shall be deposited in their office.


SEC. 1. And be it enacted, That each of said ex-


aminers shall be entitled to three dollars for every


day of his actual service under the provisions of this
act, and they shall keep an accurate account of their
