seals, with a certificate of their qualification before
a justice of the peace, as hereinbefore provided, to the


mayor and common council of said town, which


said valuation and assessment shall be ratified or


rejected by said mayor and common council, as in


their judgment may seem proper; and before actu-


ally opening, closing, widening, extending or alter-


ing any street, lane or alley, the said mayor and


common council shall pay, or tender, or cause to be


paid, or tendered, to the person, his, her or their


agent, guardian or representative, the amount of


damage so awarded ; and if any person shall feel ag-


grieved by the determination of said mayor and


common council in ratifying or rejecting said return,


or in the amount of compensation awarded, or in


any matter relating to the same, he, she or they


may, within sixty days from the date of said ratifi-

cation or rejection, appeal to the Circuit Court for

shall be final ; and it shall be the duty of the said


mayor and common council to cause the papers con-


nected therewith to be delivered to the clerk of said


court, on petition, in writing, of any person feeling


himself aggrieved, and the persons appointed to as-


sess the damages as aforesaid shall be paid such com-


pensation as the mayor and council shall determine.


SEC. 26. And be it enacted, That all fines, penal-

be recovered before the mayor or any justice of the


peace residing within the corporate limits of said


town, upon a warrant issued against the offender


and directed to the bailiff in the corporate name of


the said town (except that the bailiff shall not 'be


required to have a warrant to arrest when he sees


an offence committed), and may be collected by


judgment and execution in the same manner and


with the same fees to the officers as provided for in


cases of small debts; and the said fines, penalties and


forfeitures, so received, shall be paid and delivered to

and good order of the said town by being drunk, or
