any of the provisions of this act, he shall issue his

warrant for the arrest of the offender or offenders,

and for the seizure of the seines, nets, boats and

other fishing outfit, to be directed to the sheriff or
|
|

any constable of the county or other officer author-

ized to make arrests, or citizens, upon the receipt of
|
|
|
|
said warrant to arrest any person or persons violat-
|
|
|
|
ing the provisions of this act, and to seize any such
|
|
|
|
seine, net, boat or other fishing outfit, and found
|
|
|
|
being used in violating any of said provisions, and
|
|
|
|
to bring such offender or offenders before a justice
|
|
|
|
of the peace most accessible or convenient, and upon
|
|
|
|
conviction thereof the said offender or offenders shall
|
|
|
|
be fined not less than twenty dollars nor more than
|

two hundred dollars, one-half of such fine to be paid
|
fine for.

|
to the use of the informer, and the other half to the
|
|
|
|
use of the public schools of the county in which said
|
|
|
|
offence was committed, and shall forfeit the seine,
|
|
|
|
net, boat and other outfit used in such fishing, which
|
|
|
|
shall be sold and the proceeds divided in such man-
|
|
|
|
ner, and in case of non-payment of the fine and
|
|
|
|
costs imposed by said justice, the said offender or of-
|
|
|
|
fenders shall be confined in the county jail for a pe-
|
|
|
|
riod not exceeding forty days and not less than
|
|
|
|
twenty days, or until said fine and costs are paid.
|
|
|
|
SEC. 4. And be it enacted, That any person or
|
|
|
|
persons who may feel himself or themselves aggriev-
|
|
|
|
ed by any judgment rendered by a justice of the
|
|
|
|
peace under the provisions of this act, shall have

|
timore county, upon condition and subject to the
|
|
|
|
regulations now provided by the general law regu-
|
|
|
|
lating appeals from justices of the peace, but execu-
tion of the judgment of the justice of the peace
|
|
|
|
shall not be stayed, unless the party appealing shall
|
|
|
|
give bond to the State in double the amount of fine
|
|
|
|
imposed, with security approved by the justice ren-
|
|
|
|
dering the judgment, with conditions to prosecute
|
|
|
|
his appeal with effect or to pay the fine imposed
|
|
|
|
with all costs.
|
|
|
|
SEC. 5. And be it enacted, That this act shall take
