798 CECIL COUNTY. [ART. 8.

dollars and not more than ten dollars for each offence, with the
costs of prosecution; and all prosecutions shall be in the name of
the State, before a justice of the peace of the election district in
which such violation may occur; and of all such fines, when
collected, one-half shall be paid to the informer and the other
half to the treasurer of said county, to be applied to the support
of the public schools of said county.

1874, ch. 474.

46. The possession by any person, within said county, of any
of the above-mentioned birds, shot, killed or otherwise destroyed,
shall be prima facie evidence of the violation by such person,
of section 43; and it shall be the duty of the constables of said
county to arrest all persons they may detect in, or who may be
charged with the violation of either of said sections, and take
them before the nearest justice of the peace, to be dealt with
According to law.

RIDGE OVER SASSAFRAS RIVER.

1870, ch. 415.

47. All persons passing over the Sassafras river bridge on
horseback, in carriages, carts, wagons, sleighs, or other vehicles,
shall be required to put their horses in a walk, otherwise they
shall be fined five dollars for each and every offence; it shall be
the duty of the bridge tender to see to the enforcement of this
section; any justice of the peace for either Cecil county or Kent
county in which any party violating the above provisions may
be found, shall have jurisdiction in the matter; and the penalty
shall be recovered in the name of the county commissioners of
said counties, in an action for debt.

48. All captains, owners, masters and sailors of vessels, going
through the draw of said bridge, shall be required to lower and
take in as much sail as shall be necessary to prevent damage by
carelessness before going through the same, and at a sufficient
distance therefrom, to remove liability of injury or damage to
said drawbridge by the headway of such vessels, and shall use in
the management of said vessels reasonable care to prevent injury.
