county, shall pay a fine of five dollars for each partridge, rabbit,
woodcock, rail bird or pheasant shot or taken, or exposed for
sale, and on failure to pay said fine, shall be lodged in the county
jail for a term of not less than ten nor more than thirty days.

40. Any person found trespassing with dog or gun upon any
private property in said county shall be liable to be arrested by
any constable of said county, and on conviction thereof before
any justice of the peace of said county, shall pay a fine of five
dollars and on failure to pay said fine shall be confined in the'
jail of said county for a term of not less than five nor more than
ten days.

41. Any party against whom any justice of the peace shall
render a judgment under the provisions of the three preceding
sections, may, at any time within twenty days from the rendition
thereof, appeal from such .judgment to the circuit court for the
county.

42. The fines which may be collected under the provisions of
sections 38, 39 and 40, shall be paid by the justices of the peace
to the county commissioners, to be by them placed to the credit
of the school fund of the county.

43. It shall be unlawful for any person, at any time, to shoot,
or otherwise kill or injure, or pursue with such intent, any of the
following named birds, within the limits of Cecil county, viz:
blue bird, thrush, martin, mocking bird, swallow, oriole, red bird
cat bird, sparrow, whippoorwill, wren, pewit, goldfinch, sapsucker,
ground robin, hanging bird or woodpecker.

44. It shall be unlawful for any person knowingly and
unnecessarily to destroy or disturb the eggs of any of the above
mentioned birds.

45. Any person violating either of the two preceding sections,
shall, on conviction thereof, be fined a sum not less than two
