the county to sell at auction within the limits aforesaid, and to
such persons as shall sell at auction, goods, wares or merchandise

sent into the county, and the limits aforesaid, for the express pur-
pose of being sold upon commission.

36. Any person who shall eo sell within the said limits, with-
out having previously paid the license herein directed, shall be
liable to a penalty of one hundred dollars for each offence, to be
recovered by the State in the same manner as debts of like'
amount are recoverable.

37. The clerk of the circuit court shall be entitled to the same
fees and commissions for issuing the license, and paying into the
treasury the money therefor, as for like licenses under the laws of
this State.

38. It shall not be lawful to shoot, trap or kill, or in any

manner destroy or expose for sale any partridge or rabbit in
Cecil county between the tenth day of January and the first day

of November, and in Harford county between the twenty-sixth

day of December and the fifteenth day of October; nor any
woodcock between the first day of January and the tenth day of
June in either of said counties; nor any rail birds, reed bird or
pheasants, between the first day of February and the fifth day of
September in each year, in Cecil county; nor any rail birds or
pheasants, between the first day of February and the first day of
September in each year in Harford county; and the possession of
any of the birds or game mentioned in this section during the
prohibited periods shall be deemed prima facie evidence against

such persons of a violation of this section, except when it may
appear that such birds or game are for breeding purposes.

39. Any person violating the provisions of the preceding sec-
tion, on conviction thereof before any justice of the peace of said
