and by that name may sue and be sued, and may have and use a
common seal, and may break and alter the same at pleasure.

117. The commissioners of said village shall be five in num-
ber, and the term of office of the oldest in time of service of said
commissioners shall expire on the first Wednesday in July in
each year.

118. The male citizens of said village, of the age of twenty-
one years and upwards, who have resided in said village six
months, and twelve months in the State, shall, on the first Wed-
nesday in July in each year, elect one person qualified in all re-
spects in the same manner as the voters, to fill the place of the
commissioner whose term of office has expired.

119. All elections shall be held as the commissioners shall
from time to time by their by-laws direct.

120. They shall fill all vacancies in their number happening
by death, resignation, removal or disqualification during the year,
or if they are unable to elect, they shall order a new election, at
such time and place as they shall direct, to fill said vacancy.

121. If, during the year for which they were elected, any of
the commissioners shall die, resign, refuse to act, remove from
said village, or be otherwise disqualified, an election to fill such
vacancy shall be held, unless the commissioners shall fill the
vacancy; and all persons qualified to vote at a regular election
shall be entitled to vote at such special election.

122. The clerk to the said commissioners shall make returns
of each election by the people, or by the commissioners to fill
vacancies, at such times as the commissioners shall require, to the
clerk of the circuit court for Caroline county, to be kept by him
in his office.
