oath before the mayor that he will diligently and faithfully, to the
best of his judgment, perform the duties of councilman of said

city, without fear, partiality or prejudice; and the mayor shall
take the oath prescribed by the constitution, before the clerk of
the circuit court for Allegany county or before one of his sworn

deputies.

54. At the organization of said city council on the first Mon-
day in June in each year, or as soon thereafter as may be practi-
cable, said city council shall elect by ballot one of their own
number as president of the council, who shall preside at all meet-
ings of the council, and shall have the right of voting on all
matters coming before said body; and in case of the absence of
the mayor, or in case of a vacancy in the office of mayor from

any cause, the president of the council shall be mayor pro tem.

until the same is filled, with all the powers and duties of mayor

devolving upon him; and in case of the absence or inability to
act, of both the mayor and the president of the council, said
council shall forthwith meet and elect a mayor pro tem., upon
notification by the clerk of such absence or inability.

1883, ch. 860.

55. The inhabitants of the city of Cumberland, residents
thereof for one year previous to the municipal election of said
city, and qualified to vote for members of the general assembly,
shall elect by ballot, on the third Monday of May in every second
year, accounting from the year eighteen hundred and seventy-

eight, a person of known integrity and capacity, to be city clerk;
and such person so to be elected shall, at the time of his election,
be a legal voter in said city; and it shall be the duty of said city

clerk to attend all meetings of the city council, keep a correct
journal of the proceedings of the same, and to enter on said
journal the yeas and nays upon the passage of all ordinances or
resolutions required by the charter of said city to be passed by
yeas and nays, and also to enter upon said journal the yeas and
nays upon all other questions upon which the vote is taken by
yeas and nays, which vote shall be so taken upon any question or
motion on demand of any member of said city council. It shall
further be the duty of said city clerk to keep all records, papers and
